By accessing the Website, all users (hereinafter referred to as “User”) accept the contractual, usage and data protection terms and conditions set out below in these General Terms and Conditions of Use (hereinafter referred to as “GTCU”). Use of the Website is subject to these terms and conditions and rules.

Vintage Guitars Ltd., as the operator of the online trading portal http://www.guitarsforcat.com/, reserves the right to unilaterally modify these GTC. The modified GTC will be duly published by the Operator on the home page of the Website and the Users will be informed of the modification.

Following the amendment, the use of the Website shall constitute acceptance of the amendment to these GTC.

The Agreement is not filed, is not a written contract, is concluded in electronic form only, is not retrievable at a later date and does not refer to a code of conduct. The e-mail message about the Order will be filed (electronically archived) by the Service Provider.

DEFINITIONS

Service provider: Vintage Guitars Ltd.

Customer: any person who contacts the Service Provider by using the website www.guitarsforcat.hu in order to provide a service or to purchase a used guitar, or who uses the website, invites the Service Provider to make an offer, makes an offer to the Service Provider or accepts an offer, enters into a contractual relationship with the Service Provider;

Parties: unless otherwise agreed/provided, the Service Provider and the Customer together;

Purchase price: the consideration payable for the goods and the provision of digital content.

Order: the Offer submitted by the Customer for the purchase of the Product on the Service Provider’s Website via the online interface designed for this purpose;.

Offer: a legal declaration addressed to the other party, aimed at the conclusion of a Contract, which contains the contractual elements which the offeror considers to be essential or an indication of the differences which the offeror considers to be essential in relation to the previous offer;

Contract: a contract between the Service Provider and the Customer, addressed to the other party, for the provision of a service to the Service Provider by using the website www.guitarsforcat.com or for the purchase of a used guitar, which is concluded by the acceptance of the offer by the recipient, as defined in these GTC, whereby the Service Provider is obliged to deliver the used product ordered by the Customer (hereinafter referred to as “Product”) and the Customer is obliged to pay the purchase price of the Product ordered by the Customer and delivered to the latter.

Service: the sale and actual delivery by the Service Provider of the products listed on the online platform of the Webshop for a specified consideration;

Website: the website operated by the Service Provider under the domain

TERMS OF USE OF THE WEBSITE

In connection with the service provided by the Service Provider and the sales made by the Service Provider, the Customer declares that he understands and accepts the following:

By placing an order on the Website or by using the interface of the Website designed and made available for sending electronic messages, the Customer expressly declares that he/she has read and accepted the terms and conditions of these GTC and the published Privacy Policy and consents to the processing of data.

The Customer is obliged to provide his/her real data when placing an Order. If the Customer provides untrue, false or third-party data in the course of the Order, no contract shall be concluded between the Parties and the legal relationship shall be deemed null and void. The Service Provider excludes all liability for damages resulting from the provision of false, incorrect or third party data.

The Service Provider shall not be liable for any delivery delays or other problems or errors resulting from incorrect and/or inaccurate data provided by the Customer.

The Service Provider reserves the right to delete from its database, without prior notice, any Customer who misuses the name or e-mail address of any other person or provides false Data.

The Service Provider reserves the right to refuse an Order to any User without giving any reason, and the Service Provider shall not be liable for any damages resulting from such refusal.

The Service Provider declares, and the Customer expressly accepts, that if the law or the GTC do not provide for paper-based written communication between the Service Provider and the Customer, the Parties mutually accept that the e-mail message is in itself written. The Parties agree to the foregoing with the understanding that they expressly acknowledge that the legal relationship between them is based on online cooperation (ordering products by concluding an online contract), and that the primary basis for communication between them is therefore e-mail correspondence.

CONTRACTING PARTIES

The contracting parties to the Contract are the Customer and the Service Provider (hereinafter jointly referred to as the Parties).

PLACE AN ORDER

No registration is required to make a purchase.

Ordering – by collection at our premises:

Select the instrument you wish to purchase, go to the “ask for more infos” box and fill in the contact form, please provide your details and when you can pick up the product in person.

If you pick up at our premises, we will give you the opportunity to try the product.

Payment in cash is only possible by personal delivery.

Order with home delivery:

Select the instrument you wish to purchase, go to the “ask for more infos” field and fill in the contact form, in the “your message/questions” field please enter your details and where you would like the product to be posted.

We will send you the shipping costs individually, after you have provided the requested delivery address, by email as part of the offer.

If you are satisfied with the offer, please send us an acceptance email.

Payment method is always by bank transfer to our dedicated bank account.

Confirmation:

The Customer acknowledges that the contract between the parties is concluded when the Supplier notifies the Customer of the details of the order, sends the proforma invoice and the expected date of delivery by confirmation email. From that date onwards, the Parties shall be obliged to perform the contract subject to the provisions of these GTC.

In case of delivery, we will send you an additional email after the package has been dispatched!

Date of dispatch: the next working day after the product purchase price is credited to our bank account.

DELIVERY:

Delivery time within Hungary is 1-2 working days.

Within the European Union: 3-10 working days

In case of other delivery destinations, the delivery can be tracked on the tracking system of the delivery service provider.

In the event that any of the ordered products cannot be delivered or if there is any question about the delivery, we will notify the customer by email or phone.

Please note that we do not provide returns for used instruments.

Our contracted courier service are:  DPD, TNT and DHL will handle the delivery of the product.

Invoicing

Our Company uses electronic invoicing, which is sent to the User by email. By accepting these GTC, you consent to the use of electronic invoicing.

Purcase Prices

Purchase prices on the website are valid for personal delivery at our headquarters. Prices on the website are in euro.

The VAT content of the invoice is 0%, as the equipment is purchased from private individuals and is therefore taxable at the marginal rate.

If the sale is made outside the EU ( the buyer is a non-EU citizen ): the tax and duty in the country of destination is payable by the buyer on receipt of the goods.

The seller has no obligation to inform the buyer of the amount of tax and duty, it is always the buyer’s responsibility.

The possibility of the Seller changing the prices for commercial policy reasons cannot be excluded. Changes to prices do not apply to contracts already concluded.

If the Seller has indicated the price incorrectly and an order for the product has been received but a contract has not yet been concluded between the parties, the Seller shall act in accordance with the “Procedure for incorrect price” clause of the GTC.

Procedure in case of incorrect price

The price is considered to be obviously incorrect:

A price of EURO 0

A price reduced by a discount, but incorrectly indicating the discount (e.g.: in the case of a product of 1000 EURO, a product offered for 500 EURO with a 20% discount indicated).

In the case of incorrect indication of the price, the Seller offers the possibility to buy the product at the real price, in the possession of which information the Customer can decide whether to order the product at the real price or to cancel the order without any adverse legal consequences.

LANGUAGE OF THE CONTRACT, FORM OF THE CONTRACT:

The languages of the contracts covered by these GTC are Hungarian or English.

RELEVANT LEGISLATION

The Contract shall be governed by the provisions of Hungarian law.

RETURNS  –  Take-back guarantee:

We are not able to offer a return guarantee for used products. Our used products can be viewed and tested in our head office before purchase. If you choose the delivery option, you have waived the right to try the product. For used products, please collect the product in person. Of course, we are also happy to send it by courier on request. Thank you for your understanding.

SERVICING

If the unit is not collected within 10 working days of the repair being reported ready for service, and it has not been agreed in advance, a storage fee of EUR 5 per day will be charged.

If the appliance is not accepted by the customer within 90 days of delivery and is not agreed with the service in advance, the service may use the appliance for its own purposes, exercising its right to use the appliance for its own purposes, with reimbursement of its outstanding costs.

COMPLAINT HANDLING:

If the Customer has a complaint about the contract or its performance, he/she may make the complaint in person at the shop, by e-mail or by post:

The Service Provider will promptly investigate the oral complaint and remedy it as necessary.

The Service Provider shall take minutes of the written complaint and of the oral complaint, if it is not possible to investigate it immediately or if the Customer does not agree with its handling, and shall provide the Customer with a copy of the minutes. The minutes shall contain the Service Provider’s preliminary position.

The Service Provider shall reply to the written complaint in writing within 30 days. The Service Provider shall state the reasons for rejecting the complaint.

The Service Provider shall keep the minutes of the complaint and a copy of the reply given by the Service Provider for a period of five years and shall hand them over to the supervisory authorities at their request.

In the event of a complaint being rejected, the customer may refer the matter to the consumer protection authority or the conciliation body and initiate proceedings.

If the above procedures are not used by the Customer or if they do not lead to a result, the Customer shall be entitled to enforce its claim or demand before a court.

COPYRIGHTS

Pursuant to Section 1 (1) of Act LXXVI of 1999 on Copyright (hereinafter: Copyright Act), the website is considered a copyright work, and therefore all parts of it are protected by copyright. The Copyright Act (Szjt. Pursuant to Article 16 (1) of the Copyright Act, the unauthorised use of the graphics, software, computer programs or any other application that may be used to modify the website or any part thereof is prohibited. Any material from the website and its database may be reproduced, even with the written consent of the copyright holder, only with reference to the website and with acknowledgement of the source. The copyright holder is Hognorsk Ltd.

PARTIAL INVALIDITY, CODE OF CONDUCT

If any provision of the GTC is legally invalid or ineffective, the remaining provisions of the contract shall remain in force and the provisions of the applicable law shall apply in place of the invalid or defective provision.

The Seller does not have a code of conduct under the Unfair Commercial Practices Act.
